Using this site
These Terms of Use (the “Terms”) govern your use of the Poorman's Ascent website. By using the Service you agree to the following:
You Agree to the Terms. You accept these Terms and Poorman's Ascent Privacy Terms. If you don’t agree with the Terms, then please do not use the Service. We may update these Terms and the Privacy Policy; the "last updated" date shows the current version. If you have a paid plan, we'll email you before a material change takes effect. If you keep using the Service after that, the updated Terms apply.
The content of this site is for reading and for deciding whether to work with Poorman's Ascent. You may not copy or resell it as your own.
Your website is yours to use for your business. If you have a hosted plan, you may use your site, its content, and the features on your plan for any lawful commercial purpose: selling, advertising, taking bookings or payments, and anything else your business does. "The Platform" below means the Poorman's Ascent hosting, account portal, code, and templates that run your site, which stay the property of Poorman's Blend LLC (see Canceling and what you keep).
We grant you a limited, revocable, nonexclusive license to use the Platform while your plan is active, and to link to this site as long as the link isn't false, misleading, or derogatory and doesn't misrepresent who owns it. We can suspend or end access for anyone who breaks these rules, for example by:
- Reselling, sublicensing, renting, or giving others access to the Platform itself, or your account credentials, without our written consent.
- Using spiders, scrapers, bots, or other automated tools to copy the Platform or this site, or to put an unreasonable load on it.
- Reverse engineering, decompiling, or making derivative works of the Platform's code or templates, except for the site export you're entitled to when you leave.
- Misrepresenting who owns the Platform, or using your site for anything unlawful.
Website plans and what's included
Hosted plans are Starter, Business, and Business + Tools, as described on the pricing page. Each plan has a page limit and, on Business and Business + Tools, a number of included change minutes each month.
A change is copy, an image, or a small layout tweak on an existing page. A new page, module, or integration is quoted separately. Unused change minutes do not roll over, and extra changes are billed at $45 an hour.
Billing and renewal
Plans are billed monthly or annually in advance and renew automatically until canceled. Payments are processed by Stripe.
If a payment fails, Stripe retries it. If a balance is still unpaid after 7 days, your site may be suspended; after 30 days it may be taken down. Paying the balance restores a suspended site.
Refunds
Setup fees and one-time add-on fees are not refundable. Monthly charges are not refunded. Annual plans canceled within the first 30 days are refunded for the unused months.
$0 down and the minimum term
With $0 down, the setup fee is spread over 12 monthly installments and the plan has a 12-month minimum term. If you cancel during the minimum term, the remaining setup balance is due in full.
Add-ons
Add-ons can be one-time, monthly, or both, and can be added or canceled individually. Canceling a monthly add-on stops it from the next billing period.
Canceling and what you keep
You can cancel anytime (after the minimum term, if you chose $0 down). Hosting ends at the end of the current billing period.
You own your domain, your content, your images, and your trademarks. When you leave, and once any remaining balance is paid, you receive an export of your content and images and a static copy of your site. The platform, code, and templates I use to build and run sites remain the property of Poorman's Blend LLC.
Support and maintenance
Business + Tools includes priority support; other plans include standard support. There is no uptime guarantee (SLA). I apply updates and security patches regularly and schedule planned maintenance for low-traffic times when possible.
Pricing changes
Existing clients keep their current price until they change plans or add a module; then the current published prices apply. I will give notice before any other price change takes effect.
Contract development work
Contract development engagements are covered by a separate written agreement that sets the rates, invoicing terms, confidentiality, and ownership of the work.
